Fluxforge acts as a data processor for customer pipeline data and a data controller for account information.
7. CCPA Rights (California Residents)
Under the California Consumer Privacy Act (CCPA), California residents have the right to know what personal information we collect, the right to delete personal information, the right to opt-out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising CCPA rights. 8. Third-Party Services
We use trusted third-party service providers including: Stripe (payment processing), AWS and Google Cloud (infrastructure hosting), Intercom (customer support), Mixpanel (analytics), and SendGrid (email delivery). Each third party is bound by data processing agreements and is prohibited from using your data for any purpose other than providing services to Fluxforge.

Terms of Service

1. Acceptance of Terms
By accessing or using Fluxforge's Services, you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Services.
2. Description of Services
Fluxforge provides a cloud-based workflow automation and CI/CD orchestration platform accessible via web browser and API. The Services are provided on a subscription basis and include pipeline management, monitoring, analytics, and integration features as described in your selected plan. We reserve the right to modify, suspend, or discontinue any aspect of the Services with reasonable notice.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You must not use the Services for any unlawful purpose, to transmit malicious code, to interfere with other users' access, or to violate any applicable laws or regulations. Each subscription is for the specified number of users; you may not share credentials.
4. Intellectual Property
Fluxforge retains all intellectual property rights in the Services, including all software, algorithms, designs, and documentation. You retain all rights to your own data, pipeline configurations, and code that you process through the Services. You grant Fluxforge a limited license to process your data solely for the purpose of providing the Services. You may not reverse engineer, decompile, or create derivative works based on the Services.
5. Service Level Agreement
Fluxforge commits to 99.9% monthly uptime for Business and Enterprise plans. In the event of downtime below this threshold, affected customers are eligible for service credits as outlined in our SLA documentation. Planned maintenance windows are excluded from uptime calculations and are communicated at least 48 hours in advance.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Fluxforge's total liability for any claims arising under these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim. Fluxforge shall not be liable for indirect, incidental, special, consequential, or punitive damages.
7. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in any court of competent jurisdiction.
